We are again trying to get the Amended and Restated Declaration of Protective Covenants For Dos Rios Unit 3 out to you. Enclosed you will find a new ballot so you may cast your ballot.
Voting will begin September 23rd and run for 30 days ending midnight October 22. Like last time, you may vote by mail, email or online. Online voting was by far the most popular. Just go to dosrios3.com and click on “Vote”. Quick, easy and safe.
Why are we voting when it didn’t pass last time? Several reasons: A large majority of those who voted did vote “yes”, but we did not get enough people to vote to meet the amount required by state law to pass. Another reason, our Covenants are about 40 years old and need updating to meet current law. The biggest reason might be that at our annual meeting several years ago we voted to update the covenants and potential changes. A committee made up of 8 homeowners went through the Covenants and made their recommendations. Our legal council then went through it and added additional clarification and made suggestions to reflect state law. The Board has adopted those recommendations and now we have a new ballot.
Our survey showed that the number of vehicles was a hot topic in the previous voting. We wanted to have a separate item to vote on this go around to let people pick the number of vehicles. Our lawyer felt that that was difficult at this time and if we did it that way could be legally challenged. Thus, the board has decided to try and get most of the upgrade to the covenants done with this ballot. Following the passage of this ballot the board will immediately put it out to vote, should the covenants be amended to allow for 4 vehicles and should they be parked on a hardened surface or not.
We have included a list of “Changes in Covenants”. This document provides more info on what has changed from the original Covenants and why. Hopefully this will help in understanding the changes. Out of all the highlighted changes, most are made to clarify our covenants or bring our covenants into compliance with state law or federal law. The original and Amended and Restated Covenants, which are proposed may be found enclosed as part of the ballot and on our website.
Remember the Annual Meeting will be held at the Dos Rios Golf Course Club House on September 23. We will start with some social time and snacks at 5:00 PM. Our HOA legal council will be there with the Board members to help answer any of your questions. If you can’t make it to the Annual meeting, just send an email to dosrios3hoa@gmail.com and we will do our best to answer your questions. Please include your phone number with the best time to call so that a Board member can call you if your question can’t be answered easily.

The Board is asking that you all take a few minutes of your time and vote. Your Vote is your choice but the Board is asking that you vote yes. We all need to participate in this process.
