Good Day, 

It has been several years in the making but the big day is here! The big day of course, is we have completed the Proposed Covenants For Dos Rios 3 HOA, and here is your ballot. If you have signed up or paid your dues online you will receive a hard copy by mail, plus an email copy. If you haven’t given us your email, you are receiving only the paper copy. 

So, what is the big thing about updating the Covenants? The last time the Covenants were updated was 2005. Since then, the laws of Colorado that govern and limit the powers of HOA’s have changed several times. The latest important change was with the passage of CCOIA (Colorado Common Ownership Interest Act) of 2024. Thus, there is a big need to update our Covenants so we will be in full compliance with CCIOA. In 2022, at the Annual HOA meeting, those present voted to look at the Covenants and suggest changes for approval. Those proposed changes were developed by the Covenant Committee, plus a few additional changes that our lawyer determined should be included. Those proposed changes are now complete and ready for you to review and to vote on. 

We want you to be able to compare the proposed and existing Covenants before you vote. Sending both Copies of the Covenants, plus ballot and this letter would end up filling our mailboxes. We have posted both the 

Proposed and Existing Covenants for you to go through on our website, dosrios3.com. If computers are not your thing and you would like paper copies of the Covenants, call or talk to a board member and they will drop a copy off at your house. 

Most of the changes are to bring us into compliance with current law (CCOIA). However, there are some definite changes to several sections. Those are as follows: 

Section 3. F. Dwellings – Limits adding Accessory Dwelling Units; 

Section 10. Signs – Allows for Signs on property temporarily, only signs which are allowed by law; 

Section 13. Exterior storage of vehicles – These changes would allow up to 4 vehicles and/or recreation equipment, to be stored on hardened parking surfaces, up from 3; 

Section 14. Limits to Short Term Rentals – This would eliminate short term rentals, except for existing known short term rentals that had prior Board approval. 

On our website please compare the two documents and please VOTE. To see the documents go to our website, click on “About” on the menu line. Next, click on “Covenants & Records”, from there you can click on “Current Covenants” or “Draft Covenants with Highlighted Changes”. Compare them and use your power and VOTE on the proposed changes. 

Remember, under our bylaws, the owners of each of the 92 lots in Dos Rios 3 get one vote, if in “good standing”. Good standing is defined as “such members shall have fully paid all assessments due…” You can also pay your dues online if you haven’t paid them yet or mail your check in with your ballot, if that is your preference. 

For the Covenants to pass, we need to have 67% of the 92 lots voting “YES”. My math skills say that 62 lots must vote “YES”. You may wonder what happens if it does not pass? Two things happen: One, the existing Covenants stay in place, in full force and effect. Two, we will take the information from the reasons given for the “NO” votes and rework those Sections. If necessary, we would separate out those Sections of concern for an individual separate ballot from the rest of the Covenants. This could be two or more Ballots. 

Voting will begin on March 24, 2026 and continue for 60 days, ending May 23, 2026. You may vote by Mail, email or online on our website. On April 23, between 4:00 PM and 6:00 PM, at the Gunnison County Library Community Room A, Board Members will be available for any members to stop by and ask questions about the proposed changes. We will also have ballots available if you wish to vote at that time. 

With everyone studying the Covenants and voting, all of us will be knowledgeable of the Covenants and what we will abide by. We can all walk around our houses and either pat ourselves on the back that we don’t need to do anything or make our plans to come into compliance. If my kids were still home I would say, “I have a fun job for you kids, you can help bring us into compliance”. 

Spring is just around the corner, looking outside, I think summer arrived this week! With spring showing on the calendar, come plans to make improvements, paint, add hot tubs, make gardens, plant trees, etc. Just a reminder, all plans for exterior improvements need Architectural Committee approval. If you are planning improvements on the outside of your home, go to dosrios3.com and click on “Menu”, then “Architectural Review”, fill in the blanks for Project Review and the Architectural Committee will get busy looking at it for approval. It is as painless as ordering a pair of shoes on Amazon and you don’t need a credit card.

3/1/26 HOA Update

Good day everyone,

Wanted to let everyone know that we are getting close to sending the ballots out to vote on the changes to the Covenants. The ballot will come out with all the changes combined with a “yes” or “no” vote. It will take 67% of the lot owners voting “Yes” to pass the Covenants. The plan is to allow  60 days to vote. A couple of weeks after the ballots are sent, we will have a meeting to answer any questions. If the ballot fails, we want to know why you voted against it. We will make modifications to those items that were a reason for “no” votes and come back out again with the modified ballot.  

Under the existing and proposed Covenants to vote, all lot owners need to be in good standing, which means our dues need to be paid. So, if you haven’t paid your dues yet, you can mail them or go to our website and click on “pay dues”.  A lot of people have been paying online.  

In other news, we have an online form for the Architectural Review Committee to look at any proposed projects, which need their approval. If you’re thinking of any improvements or changes on or around the house, we think this will make approval easier. A hard copy form is attached for you to look at. We hope this will simplify the process and have already tested it with an actual request.  You can get to the form to enter your request by going to  www.dosrios3.com.  Once on our web page, click on the “Menu”, then on “Architectural Review” if using a phone. If on a desk top, just click on “Architectural Review”. The form also lets you know what projects need approval.

Looks like spring decided to arrive way early this year.  The snow is mostly gone and vole tracks are showing up in many yards. We need snow so maybe we should clean up all the winter stuff and put it away and we will get a big dump of much needed snow. I know someone that bought a new big snowblower and hasn’t been able to use it, so maybe we can counteract that.

2025 Annual Meeting Recap

Good day HOA Members,

Well another year has passed and another Annual HOA Members meeting has passed. I want to take a few minutes to update you on some of the results of the meeting. Lets start with the results of the election creating your new HOA Board.  Here is your new board:

Sean McCormick gave a presentation on the proposed revised Covenants at the meeting with discussion following. The proposed revised Covenants are on our website.  Once on the website hit “Menu“, then “News”.  then scroll down to

“Proposed Covenants”.  Please take a look at them and if you have any concerns please let a board member know or go to “Contact” on our web page and give your comments that way. You may also send an email to dosrios3hoa@gmail.com.  We hope to put the Covenants out in early November for vote.  It will take 67% of the members to vote yeas to be adopted by Colorado Law.  So if you have comments get those in soon.

The other big discussion item was what is happening to the pasture land just east of Fairway Lane.  The County has proposed changing the Special Area Regulations to allow between10 to 20 housing units per acre.  There has been a public meeting on the issue, with 60 + people from the area in attendance, letting their voices be heard.  Thank you to all that could attend and for taking the time to do so.  If you wish to comment on this proposal by the county you may do so in writing by sending an email to (planning@gunnisoncounty.org).  We will work to keep you all informed as we learn more information.  The quickest and easiest way to keep you informed is by email, due to limited time to get info out it is not possible to do it by USPS. I think that is the big news from our annual meeting.  The next Board Meeting will be November 5th at 4pm at the Gunnison County Library. We will be meeting in Community Room B.  The agenda is as follows:

Spring 2025 Newsletter

 Wanted to let everyone know that Spring Clean-Up dumpsters will be back this spring at the corner of Tomichi Trail and Fairway Lane. This year we are adding a second weekend for organic yard waste (grass clippings, limbs, unpainted wood with no nails or screws). 

May 31 thru June 1 Regular Trash 

(Dumpster will arrive Friday, May 3,0 in the evening and be picked up on June 2) 

There will be a large dumpster for spring cleanup for items you would like to discard from around the house. This dumpster is being provided for spring clean-up, and we must meet the rules of the County Landfill. We need to follow these rules to avoid any problems in being accepted at the landfill and/or incurring extra charges. Please ensure that you do not throw any of the following items in the dumpster. 

*Dry empty paint cans with the lid off can be placed in the dumpster. 

We cannot fill the dumpster above the rim, so please break apart and flatten bulky items. Do not place anything in the dumpster if it is not fully below the rim. 

June 7 thru June 8 Organic Yard Waste 

Friday, June 6, in the evening, a dumpster will be delivered that will take organic yard waste to the City Tree Dump. Like the County Dump, there are Rules on what we can put in this dumpster. 

Only organic yard waste (grass, leaves, limbs, and untreated wood) 

Just a few words about other HOA Business: Most everyone has paid their dues for 2025 but it is an easy thing to forget. If you haven’t paid your dues you can send your check to Dos Rios 3 HOA, Box 7080, Gunnison. You may also go online and pay at dosrios3.com, click on the “Menu” button, then click on the “HOA Dues”. Most members have paid through this quick and easy process. Thank you! 

Also, a quick reminder as we get to home improvement season. If you’re planning any home or landscape improvements, including color changes you may need Architectural Committee approval. It is easy to do by going online to dosrios3.com, click on “Menu” then click on “Architecture and Review”. Tell them your plans and they will let you know if you need approval or are good to go. Again, thank you! We have seen many plans and appreciate you submitting them. 

The covenant committee continues to work on looking at our covenants and developing suggested changes and updates. We hope to have these available to present at the annual meeting in September and start the voting process for approval. It is important to note that the existing covenants are in effect until changed. The Board has made the decision not to pursue enforcement of covenants that might be changed until after being voted upon. Please be aware that if the Board receives a formal complaint, it has no choice but to take action and work with the homeowners on coming into compliance. Please take a look at the covenants available on our website, and see if you are in compliance or close to compliance. I know the neighborhood will appreciate our work. 

The next Board Meeting will be June __, at 4:00 PM in the Gunnison County Library.

Spring 2025 Newsletter

March 26, 2025

Good Day members,

Here it is still March and the tempertures might hit 60 degrees today or tomorrow. My bet is we will see some more snow before our real spring begins, but I will definitely enjoy these nice days.

We had a HOA Board Meeting last week and discussed progress on the updating of our Covenants and the need for clarification of some of our regulations.  With the updated covenants the Board will begin reviewing the proposals and meet with our attorney to ensure they are legal and meet Colorado Law.  The plan is to then send them out for vote to all of our members.  We appreciate your patience with all of this it is a slow process.

With the warmer weather people will be looking at cleanup and improvements to their property.  We already have homeowners contacting the Architectural Committee for approval of home improvements. Remember that changing the color or appearance of the outside of your house or outbuildings does require approval of the Architectural Committee.  You may contact the Committee on our website https://dosrios3.com, click on ”Menu”  then the “Architectural & Review” tab.

Our next board meeting we will be determining what to provide for spring cleanup.  Last year we provided a dumpster and Six Points brought their donation van on Saturday morning.  This year we will look at wether to continue  the dumpster and add a trailer for dumping yard waste to go to the City Tree Dump.   Please let a board member know if you have any opinions about the spring clean up. The online Payment option for paying your dues has proven to be very popular with most people paying their dues online. We only had one member where the online payment didn’t work, we think that issue is solved..  Thank you to all that have paid. If you haven’t paid go to the website   click on ”Menu”, then click on the “HOA Dues” or mail your dues to PO Box 7080.

As you may know, there was a County Planning Commission Meeting on the subdivision of property sitting on the east side of Fairway Lane.  The proposal was to divide off approximately 7 acres which include the barns and corrals south of the KOA and Hartman Castle.  This acreage would be sold to the current lessee. The remaining 102 acres would continue to be leased for livestock grazing to the same rancher. There are no other changes requested at this time.  We did have a homeowner at the meeting. The County was asked to ensure that an easement exists to the remaining 102 acres from the county road that runs in front of the Hartman Castle and that the sale of the 7 acres will not block this access off. The good news out of this is that there is no development being asked for dealing with the land just east of Dos Rios 3.

Recently I had someone ask me after receiving their county water and sewer bill if the sewer prices went up due to sump pumps underneath houses that might be running into the sewage system.  I don’t know, the County did say treating unnecessary water does add to the cost. It is a good reminder though to check your crawl space and make sure if you have a sump pump it is not going into the sewer system. I know the County plans to continue to investigate unnecessary water coming into the sewer system.   

The next HOA Board meeting will be held at the Gunnison County Library on April 23 at 4:00 pm.  The agenda is as follows:

Good news, we have found out that the County will be hosting a Household Hazardous Waste collection on April 24-25 at the County Public Works building. This includes such things as; oil based paints, old antifreeze, and old insecticides.  All things that can’t go to the landfill. There should be more info on the County PublicWorks website soon.

Enjoy this time of year, spring in Gunnison does remind us that nothing is constant, it is always changing.

Summer 2024 Newsletter

Good Day members,

What a wonderful June we have had so far, hope the rain continues which makes keeping a lawn nice and green a lot easier.

I would like to share a few items of information with all of you.

  1. Dos Rios 1 HOA requested we let everyone know they do not want any yard waste thrown onto their common property and request it please stop. They pay to treat their common ground for weeds and do not want any potential weeds coming onto their land from Dos Rios 3 lawn and garden waste.
  2. The board has received a few comments and complaints about the clutter around some homes. We all live in the neighborhood together and as neighbors we need to be aware of how we keep our yards and do our part to keep the neighborhood looking great. We appreciate you helping out!
  3. If you haven’t gone to our website https://dosrios3.com and given us your email, we ask that you go to the website and click on the menu button and select “Contact” then click on “Newsletter Subscription” and then sign up for the newsletter. We hope to move to all electronic notices by this fall so we do not have to spend close to $100.00 each time we mail this newsletter and notification of the board meetings.
  4. Speaking of HOA Board meetings, the next one will be on July 31, 4:00 PM in the Gunnison County Library.

Spring Newsletter

Hello Neighbors!

The Board would like to take a few minutes and give you an update on what is happening here in Dos Rios 3.

As you all have noticed, Gunnison County has improved the area around the mailboxes on Fairway Lane and Tomichi Trail. A big thank you to the Gunnison County Public Works Department and to our own Sean McCormick for working together to make this happen.

The Board has authorized the purchase and installation of two “Driver Feedback Radar Signs.” The signs are being purchased to address concerns from many residents about drivers exceeding the speed limit with a lot the children in our neighborhood. These are signs that read your speed and then show that speed on the sign. One sign will be installed on upper Fairway Lane to remind drivers of their speed as they get into the residential area. The other sign will be installed on Tomichi Trail near the mailboxes. We have applied to Gunnison County to install these signs on the County Right of Way and hope to have them installed before too long.

To assist with spring clean-up, the Board approved a dumpster to be placed at the junction of Fairway Lane and Tomichi Trail. The dumpster will be available from May 3rd until it is full or through May 9th. This dumpster is being provided for spring clean-up, and we must meet the rules of the County Landfill. We need to follow these rules to avoid any problems being accepted at the landfill and/or incurring extra charges. Please ensure that you do not throw any of the following items in the dumpster.

*NO LIQUIDS OF ANY KIND!

  • NO Concrete Tires and/or Rims Mattress and/or Box Springs
  • NO Appliances, Electronics, and/or Batteries  Motorized Equipment
  • NO  Fluorescent lights  Treated Fence Posts Railroad Ties

The Six Points box truck will be at the intersection of Fairway and Tomichi on Saturday, May 4th, from 10am to 12pm. Two staff members will be aboard: Kyle and Johnny.
The following is a list of items that Six Points is unable to accept:

  • Beds or bed parts of any kind
  • Electronics of any kind
  • Plug in Exercise equipment of any kind
  • Baby equipment of any kind, car seats, high chairs, anything that could be a concern from a safety standpoint.
  • We cannot accept helmets.
  • We understand that donations will be used and somewhat worn, but we cannot accept items with stains, smells, or tears.

The Board is also trying to make communication quicker and easier for all of us by getting an email address for each lot owner. If you could take a moment and go to https://DosRios3.com, under the “Menu” tab click “Newsletter Subscription” and fill out the form with your preferred email address. Thank you, we hope to send notices like this by email in the near future.

The Board also wants to thank all of those who have contacted the Architectural Committee regarding their planned changes, as required by the Covenants. Quite a few plans are moving forward for this year. If you have some planned changes you are thinking about, please go to https://DosRios3.com, click on “Architecture and Review”, then fill out the form to start the review process.

If you look at your latest water bill from the County you will see they are concerned about sump pumps pumping into the sewer system and increasing all of our water/sewer bills. This follows up with the information they provided at our annual membership meeting last September. The county is asking us to remind everyone to check our crawl space and change any sump pump to ensure it is not going into the sewer, hopefully saving us all some money.
