Proposed Amendment to Amend and Restate the Declaration 

Paragraph 23 of the Declaration of Protective Covenants for Dos Rios Unit 3 recorded in the real property records of Gunnison County, Colorado at Reception No. 331761 as amended by the first amendment as recorded in the real property records of Gunnison County, Colorado at Reception No. 479386, Consent to Amendment of the Declaration of Protective Covenants for Dos Rios Unit 3 recorded as Reception Nos. 557682, 558707, 558708, and 558709, and Acknowledgement of Covenant Amendment recorded as Reception No. 562780 (collectively and as otherwise previously amended, the “Declaration”) together with C.R.S. § 38-33.3-217(1)(a)(I) and C.R.S. § 38-33.3-117(1.5)(d) provide that the Declaration shall not be amended except by the owners of 67% or more of the lots within the subdivision. There are 92 lots in the subdivision. Although a quorum of members is only 47 members, to pass with 67% approval, the affirmative vote of the owners of 62 lots will be required. 

By written ballot, Dos Rios III Homeowners Association, Inc., a Colorado nonprofit corporation (the “Association”) requests that you vote on this matter. To be counted, your ballot must be returned no later than May 23, 2026. Ballots may be returned by electronic signature, email to dosrios3hoa@gmail.com, or online (below), or by physical return to Dos Rios 3 HOA, PO Box 7080, Gunnison, CO 81230

The proposed amendment is to amend and restate the Covenants in their entirety as described in Exhibit A (“Amended and Restated Declaration of Protective Covenants for Dos Rios Unit 3”). For reference, the following documents are available online on the Association’s website, https://dosrios3.com/covenants/

(1) the first amendment to the Declaration of Protective Covenants for Dos Rios Unit 3 (which includes the language of the original Declaration of Protective Covenants for Dos Rios Unit 3) 

(2) the Consent to Amendment of the Declaration of Protective Covenants for Dos Rios Unit 3 

(3) the Acknowledgement of Covenant Amendment 

NOTE:
*If the lot is owned by a trust, corporation, limited liability company or other entity, please print the name of the entity, sign on behalf of the entity, and indicate the capacity in which you are signing, e.g. trustee, president, member. There is one membership for each Lot; each membership is entitled to one vote which must be cast as a single vote (split votes are not allowed).
